1. About the Platform

All Wine Tours (“Platform”, “we”, “us”) is operated by All Wine Tours, Unipessoal, LDA, a company established in Portugal, with registered address at rua de Anselmo Braancamp 516, Porto, contact email info@allwinetours.com.

The Platform operates as an online marketplace that allows users worldwide to discover and submit booking requests for winery visits, tastings, meals, tours, other such experiences, accommodation, and restaurant services offered by independent third-party providers (“Partners”).

The Platform does not provide or operate the listed services.

2. Definitions

  • User / you: any person accessing or using the Platform

  • Partner: an independent third-party service provider (e.g. winery, hotel, restaurant)

  • Listing: a service offered by a Partner on the Platform

  • Booking Request: a request submitted by a User, subject to Partner approval

  • Booking: a confirmed reservation approved by the Partner

3. Role of the Platform

  1. The Platform acts solely as an intermediary and commercial agent facilitating bookings between Users and Partners.

  2. Partners provide the services and, upon confirmation, enter into a direct contractual relationship with the User.

  3. The Platform is not the organiser, operator, or provider of any experience, accommodation, or restaurant service.

4. Eligibility and legal drinking age

  1. You must be at least 18 years old to submit a Booking Request.

  2. Many experiences involve alcohol. You confirm that you meet the legal drinking age requirements both in your country of residence and in the country where the experience takes place.

  3. For users residing in the United States, this requires a minimum age of 21.

  4. In Portugal, the legal drinking age is 18.

  5. You are responsible for complying with all applicable laws during your participation in any service.

5. Listings and availability

  1. Listings are created and managed by Partners.

  2. Prices, availability, inclusions, exclusions, and conditions are determined solely by the Partner.

  3. The Platform does not guarantee availability or acceptance of any Booking Request.

6. Booking process

  1. Submitting a Booking Request does not constitute a confirmed reservation.

  2. A Booking is formed only when:

    • the Partner approves the Booking Request, and

    • you receive written confirmation (email, voucher, or in-platform confirmation).

  3. Partners may accept or decline Booking Requests at their discretion.

7. Payments

  1. The Platform collects payments on behalf of the Partner as a commercial agent.

  2. Your payment obligation to the Partner is fulfilled once payment is successfully collected by the Platform.

  3. The Partner remains solely responsible for:

    • delivering the service

    • determining applicable taxes

    • issuing invoices or receipts (unless otherwise stated)

    • handling cancellations and refunds according to their policy

  4. The Platform may retain a commission or service fee agreed with the Partner.

8. Cancellations, refunds, and no-shows

  1. Each Listing includes a Partner-defined cancellation policy, which applies to the Booking.

  2. Refund eligibility depends on the Partner’s policy and applicable mandatory consumer law.

  3. Failure to attend or late arrival may result in partial or total loss of payment.

  4. The Platform may assist communication but does not override Partner policies or decisions.

9. Changes and force majeure

  1. Services may be modified or cancelled due to events beyond reasonable control, including weather conditions, safety concerns, strikes, natural disasters, public authority actions, or public health measures.

  2. In such cases, the Partner’s policy applies, subject to mandatory law.

10. Alcohol consumption and personal responsibility

  1. Alcohol consumption involves inherent risks.

  2. You agree to consume responsibly and follow all safety instructions and legal requirements.

  3. The Platform is not responsible for incidents arising from alcohol consumption during any service.

11. Insurance

  1. The Platform does not provide travel, medical, accident, liability, or cancellation insurance.

  2. You are solely responsible for obtaining appropriate insurance coverage for your trip and participation in any service.

  3. Partners may maintain their own insurance, but the Platform does not verify or guarantee the existence, scope, or adequacy of any Partner’s insurance coverage.

12. Reviews and user content

  1. Users may submit reviews based on genuine experiences.

  2. The Platform may remove content that is unlawful, misleading, abusive, or irrelevant.

  3. By submitting content, you grant the Platform a non-exclusive right to use it for Platform operations and promotion.

13. Prohibited use

You agree not to:

  • misuse or interfere with the Platform

  • submit false Booking Requests or reviews

  • scrape, copy, or resell Platform content

  • violate applicable laws or third-party rights

14. Intellectual property

All Platform content, branding, trademarks, and software are owned by or licensed to the Platform. Use is permitted for personal, non-commercial purposes only.

15. Liability

  1. Partner responsibility: Partners are independent service providers and are solely responsible for the services they offer, including safety, quality, compliance with laws, licenses, permits, staffing, and insurance.

  2. Platform limitation: To the maximum extent permitted by law, the Platform is not liable for:

    • acts or omissions of Partners

    • service interruptions, cancellations, or changes

    • indirect, incidental, or consequential losses

  3. Nothing in these Terms limits liability that cannot be excluded under applicable law.

The Platform may assist communication but does not assume responsibility for Partner decisions.

17. Suspension and termination

The Platform may suspend or terminate access if these Terms are breached or unlawful activity is suspected.

18. Governing law and jurisdiction

These Terms are governed by the laws of Portugal.
Nothing in these Terms affects mandatory consumer protection rights applicable in your country of residence.
Portuguese courts shall have jurisdiction, unless otherwise required by mandatory law.

19. Changes to these Terms

The Platform may update these Terms from time to time. Continued use of the Platform after updates constitutes acceptance of the revised Terms.
